By accessing the Site, requesting a quote, scheduling a consultation, or otherwise engaging with us, you ("you" or "User") agree to be bound by these Terms. If you do not agree, do not use our Site or services.
By using the Site or engaging with our representatives, whether online, by telephone, by text message, or in person, you acknowledge that you have read, understood, and agreed to these Terms and to our Privacy Policy, which is incorporated by reference. If you are entering into these Terms on behalf of another person or entity, you represent that you have the authority to bind that person or entity.

We reserve the right to refuse service, suspend, or terminate access to our Services for any User who does not meet these eligibility requirements or who violates these Terms.
Any savings estimate, quote, system size, projected production, financing rate, or pricing information presented through the Site, by a representative, or via any communication channel is non-binding and informational only. Final pricing, system specifications, financing terms, and installation timelines are set forth only in a written installation agreement (or comparable service agreement) executed between you and us or our Installation Partner.
Solar production estimates, energy savings, and projected utility-bill reductions are estimates only, calculated using industry-standard tools (such as NREL PVWatts) and assumptions about your roof orientation, shading, weather patterns, utility rates, and household energy usage. Actual performance and savings may vary, and we do not guarantee any specific level of energy production, cost savings, or financial return.
Information about federal, state, or utility tax credits, rebates, or incentives is provided for your convenience and is not tax, financial, or legal advice. Your eligibility for and ability to use any tax credit or incentive depends on your specific tax situation, financing structure, and applicable law. Consult a qualified tax professional regarding your eligibility before relying on any such information.
By providing your contact information to us, you consent to receive communications from us as described in our Privacy Policy, including by phone, text message (SMS), and email. SMS communications are governed by Section 3 of the Privacy Policy. Standard message and data rates may apply.
You may opt out of marketing communications at any time as described in the Privacy Policy. Opt-out from marketing communications does not opt you out of transactional communications necessary to complete an active service request.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use to learn about our Services and request a quote.

All content on the Site, including text, graphics, logos, images, photographs, designs, software, and the "ElevateAI" name and logo, is the property of ElevateAI LLC or our licensors and is protected by U.S. copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you. Unauthorized use of any of our intellectual property is strictly prohibited.
Any feedback, comments, suggestions, ideas, or other materials you submit to us (other than personal information governed by our Privacy Policy) are non-confidential and non-proprietary. By submitting such materials, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, and display such materials in any medium, in connection with our business, without compensation to you.
The Site may contain links to or integrate with third-party websites, products, or services (including, without limitation, Comcast/Xfinity, financing providers, Installation Partners, Google, Meta, Twilio, and analytics providers). We do not control, endorse, or assume responsibility for any third-party content, products, or services. Your interactions with any third party are solely between you and that third party, governed by that third party's terms and policies.
The Site and any informational services provided through the Site are offered "as is" and "as available," without warranties of any kind, express or implied.
To the maximum extent permitted by applicable law, we disclaim all warranties, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted access.
We do not warrant that the Site will be error-free, that any defects will be corrected, or that the Site is free of viruses or other harmful components. Any warranty applicable to a solar installation, equipment, or other product or service purchased from us or our Installation Partners is governed exclusively by the written warranty provided in the applicable installation or service agreement.
To the maximum extent permitted by applicable law, in no event shall ElevateAI LLC, its officers, directors, employees, agents, affiliates, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including, without limitation, lost profits, lost data, lost goodwill, or business interruption, arising out of or in connection with your use of the Site or our Services, even if we have been advised of the possibility of such damages.
In no event shall our total aggregate liability arising out of or in connection with these Terms or the Site exceed the greater of (a) the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
You agree to defend, indemnify, and hold harmless ElevateAI LLC and our officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of or access to the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right or privacy right; or (d) your provision of false, misleading, or fraudulent information.
Before filing a formal legal claim, you agree to first contact us at info@elevateaihome.com and provide a brief description of the dispute and your contact information. We will attempt to resolve the dispute informally for at least thirty (30) days before either party initiates a formal proceeding.
Except for claims that may be brought in small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
The arbitration shall be conducted in Cumberland County, Pennsylvania, or another mutually agreed location, and judgment on the award may be entered in any court of competent jurisdiction.
You and ElevateAI LLC each agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and we waive any right to a jury trial.
You may opt out of the arbitration and class-waiver provisions of this Section 13 by sending written notice to info@elevateaihome.com within thirty (30) days of first agreeing to these Terms. Your notice must include your full name, address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provisions of these Terms.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. Subject to Section 13 (Dispute Resolution), any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Cumberland County, Pennsylvania, and you consent to the personal jurisdiction of such courts.
We may suspend or terminate your access to the Site or our Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all rights granted to you under these Terms will immediately cease. Sections of these Terms that by their nature should survive termination, including, without limitation, Sections 7, 10, 11, 12, 13, and 14, shall survive.
We may modify these Terms from time to time by posting an updated version on the Site. The "Last Updated" date at the top indicates when these Terms were last revised. Material changes will be communicated by posting a notice on the Site or, where appropriate, by direct communication. Your continued use of the Site after a change becomes effective constitutes your acceptance of the updated Terms.
These Terms, together with the Privacy Policy and any separate written agreement between you and us (such as an installation agreement or financing agreement), constitute the entire agreement between you and ElevateAI LLC concerning the Site and our Services.
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be enforced to the maximum extent permitted by law.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
You may not assign or transfer these Terms or any rights hereunder. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, supply-chain interruptions, third-party service outages, governmental actions, or labor disputes.
